ALLEGED rapist Venket Primo was playing the game ‘Weak Spot’ with the victim when he touched something that ended the game and resulted in the commission of the offence of rape with a 14-year-old girl.Since a girl under the age of 16 years cannot consent to a sexual intercourse, the accused was arrested by police investigators.
Prosecutrix Miss Tamieha Clarke delivered the opening address to the jury before Presiding Judge Madame Jo-Ann Barlow yesterday, disclosing that evidence would be led to show that because of the girl’s tender age, what the accused had done by means of penetration constituted a criminal offence.
The jury was told that during the ‘Weak Spot’ game, the accused tried to touch the girl’s private parts.This resulted
in the accused asking the girl for sex. She complied and the accused would give her things in return.
The prosecutrix added, “I want to point out to you right now though, that a girl of 14 years cannot give permission for sexual intercourse, because she is below 16 years. The main witness that the State is relying on to prove its case is the victim herself. This is quite normal in sexual offence cases because they usually occur in private.
“The victim will come and tell you what happened. She will give you the details. Similarly, the other witnesses will tell you what they know about this matter,” the prosecution’s spokesperson said.
