A GUYANA Water Incorporated (GWI) driver will now lead a defence in the cause of death by dangerous driving and related charges. The prosecution on Friday replied to a no-case submission made by defence attorney Mr. Fazil Azeez in a previous court hearing in the matter against Shawn Ravindra Ramai of 15 Norton Street, Lodge, Georgetown.
The defendant is charged with causing the death of Claude McPherson on February 26 last at Mandela Avenue , Georgetown, where he allegedly drove motor pick-up PRR 2923 in a manner dangerous to the public.
He was also slapped with three other charges but denied them all. Particulars of the charges said on the same day, being involved in an accident, he failed to render assistance by failing to take the injured person to a medical practitioner.
It is also alleged that on the same day, being the driver of the motor vehicle, after being involved in the accident with McPherson he failed to stop the said vehicle.
Further allegations stated that after being involved in an accident with the deceased, he failed to report the said accident within 24 hours of the occurrence.
Police Inspector Vishnu Hunt, operating from the chambers of the Director of Public Prosecutions (DPP), made a submission on behalf of the prosecution before Magistrate Judy Latchman.
In his submission, Prosecutor Hunt stated that the prosecution has adduced sufficient evidence to satisfy the court at this stage of the trial. Hunt added that a prima facie case has been established against Remai, in all the charges against him.
However, defence counsel disagreed and further argued that the inferences and adducement the prosecution raised are not based on facts.
After listening to the arguments made by both prosecution and defence, Magistrate Latchman ruled that a prima facie case has been established, in all the cases against Remai.
Hence, the court called on the defendant to lead a defence, on April 8.
