TWO different plaintiffs who are claiming two separate properties in the country will each battle their respective defendant in the Bail Court on September 8 and 10, respectively. The first claim is by Gomatie Dath against Romana Ramjit, while the second is by Kalawaty Dai Dasrat against Laaty Singh.
In a writ of summons prepared by Attorney-at-Law Mr. R.N. Poonai, Dath is claiming possession of a property situated at Lot 32 Ogle Front, ECD. Arguments in that case are to begin on September 8.
Plaintiff Gomatie Dath, of Virginia Village, Cane Grove, ECD is reputedly the owner of Sub-lot ‘C’, part of Lot 32D, Ogle, East Coast, Demerara.
Dath said she got ownership of that property by virtue of lease number 50 of 2012 for the unexpired term of 999 years.
In her statement of claim, she said she obtained a transfer of the lease by way of an execution sale at the instance of the Supreme Court on the 15th day of October, 2011.
Dath contends that the defendant presently occupies the said property as a trespasser, having acquired the legal right to occupy the said property subsequent to the execution sale and transfer of the lease.
Wherefore, she claims the following:-
(a) Possession of Sub-lot ‘C’, part of area ‘D’ Ogle, ECD, more fully described in lease No. 50 of 2012.
(b) Any such further or other orders as the Court may deem just.
And plaintiff Kalawatty Dai Dasrat is saying in her statement of claim, that she is the administratrix of the estate of Dhanpattie, also called Dhanpati. The High Court of the Supreme Court had granted her Letters of Administration on the 4th June 2012.
In a writ of summons prepared by Attorney-at-law Mr. Llewellyn John, the plaintiff contends that she is the owner of the property in dispute, and is entitled to the right, title and interest in the said 1and and the building thereon. She claims that the defendant is unlawfully occupying the building thereon.
According to Dasrat (plaintiff) the trespass consists of unlawful entry into the building aforesaid, and remaining there.
She is also seeking an injunction restraining the defendant, the defendant’s servants or agents from continuing to trespass on the land, situated at Tuschen Old Road, East Bank, Essequibo.
When this trial begins, the defendant will put her case to the court.
