Smaller trial continuing in manslaughter case of sexagenarian
LEGAL submissions by defence counsel, Rabindranauth Singh, in the absence of the jury, has resulted in a continuing voir dire (trial within a trial) in the manslaughter case of Thakumanie (only name given) at the Berbice Assizes. The proceedings were to commence on May 29 but the illness of Justice James Bovell-Drakes led to a postponement.
However, just after the jurors were ushered out of the courtroom, the judge, addressing members of the media at the press table, said he observed, in a national newspaper, mention made of a statement which was never addressed within the confines of the court and urged the reporters to desist from such practices.
Referring to the article, Justice Bovell-Drakes said that interpretation was far from what transpired.
Prior to his admonition, the judge advised the jury not to pay heed to writings in the press, with respect to the case, but only consider matters that unfold in the witness box.
Meanwhile, at a previous appearance, the 64-year-old accused sexagenarian had pleaded not guilty to the unlawful killing of her husband, Yodha (only name stated, too) at Bennett Dam, Rosignol, West Bank Berbice, on April 27, 2008.
The case is continuing.
