Former Commissioner of Title must pay $150,000 costs

JUSTICE Winston Patterson yesterday ordered former Commissioner of Title and Oaths, Mirza Sahadat to pay $150,000 costs in a civil action he lost.
Sahadat had filed 12 petitions for clients while he was retained as their counsel for them. However, subsequent to his appointment to the Land Court in Berbice, the cases were assigned to him by the Chief Justice and he gave judgements for the petitioners.
The case brought against Sahadat surrounded transported property belonging to Rafeena Ramjohn, who resides overseas but found that her Lot 103 Springlands property had been awarded to Sahadat’s client, Ameer Ali.
Ramjohn took the matter to Court, naming Sahadat, Ali and the Registrar as defendants and Justice William Ramlal, consequently, granted an injunction against the trio, pending a chamber hearing.
Last July 15, Sahadat, represented by attorney-at-law Mr. Ramesh Rajkumar, informed Justice Patterson, that he would like the issue resolved amicably.
The lawyer for Ali, Mr. Adrian Anamayah conceded that the trial was a nullity and that all resulting orders were null, void and of no legal effect.
Justice Patterson then made orders for costs against Sahadat and Ali, in the sum of $150,000 each.
Meanwhile, after 11 other petitions were granted by Sahadat, he resigned from the post of Commissioner of Title with effect from May 31, leaving a vacancy in that Berbice jurisdiction.
