WITH the opening of an account with the Republic Bank and a promise to furnish the applicants in an action case with audited accounts, the dispute between the factions of the organization has been amicably settled.
This was recently disclosed to Justice Roxane George by Attorney-at-law, Mr. Jainaryan Singh who represented the applicants.
The facts disclosed that Mr. Mohamed Alli, a prominent businessman of Mon Repos, and six other members of the Mon Repos Sunnatul Jamaat on the East Coast of Demerara filed a Motion on the 17th of June, 2009, in the Supreme Court of Guyana, seeking the President, Mr. Mohamed Khan, and the four other executive members of the Jamaat to show cause, inter alia, why the financial statements for the years 2003 to 2009 inclusive were not presented at Annual General Meetings or disclosed or made available to the members of the Jamaat, and secondly why no commercial bank has been holding the funds of the Jamaat from 2002 to 2009. These were the main issues in the motion
Justice George expressed the view that the matter was an internal one which could be settled by the members of the Jamaat who could vote out the respondents if they were dissatisfied with their management.
However, Mr. Jainarayan Singh, Attorney-at-Law for the applicants, argued that all members of the Jamaat were required to pay $500 per month for membership, and the Jamaat was in the business of renting wares for consideration. Thus, the only recourse left to the applicants was to approach the Court for relief. The matter was adjourned for the attorney who appeared for the respondents to reply.
However, in the course of the hearing, the respondents opened an account with the Republic Bank on 11th August, 2009, and promised to furnish the applicants with audited accounts from 2005- 2009 by 8th January, 2010.
Mr. Singh told the Court of the settlement on 2nd February, 2010, and in the interest of continued harmony withdrew and discontinued the motion.
The Judge made no order as to costs.
