THE saying ‘Hell hath no fury like a woman scorned’ may be of little or no importance this afternoon, when the Demerara Cricket Board’s (DCB) second Ordinary General Meeting (OGM) convenes from 17:00 h at the Georgetown Cricket Club (GCC) pavilion.
Apart from the usual welcome and opening remarks, administrative and associations’ reports, along with the reading and accepting of the minutes from the first OGM held on the June 11, there is the motion requesting the dismantling of the present executive of the DCB.
According to secretary of the DCB, Raj Singh, who spoke to Chronicle Sport via telephone, such a motion was received and is in his possession according to the Constitution of the Board and will be up for discussion at today’s meeting.
That motion, which was proposed by president of the East Bank Demerara Cricket Association (EBCA) Rohan Sarjoo, seconded by president of the Georgetown Cricket Association (GCA) Alfred Mentore with support from president of the West Demerara Cricket Association (WDCA) Anand Sanassie, is calling for the entire executive body of the DCB to be replaced.
The signatories to the motion have cited several reasons which were challenged by the embattled president of the DCB Bissoondial Singh, who said most of the claims are false and inaccurate and even cited his own reasons why the signatories wanted the DCB’s executive body dissolved and recommended that Mentore should head an Interim body until the next Annual General Meeting (AGM) of the DCB.
The Guyana Fire Service (GFS) may be asked to have a tender on standby, as the heat from this meeting may set the venue afire, as both parties will be looking to finally show reasons why they should or should not be replaced.
Meanwhile, Chronicle Sport was reliably informed that the signatories of the petition were served with a writ on behalf of the DCB president, assistant secretary and treasurer respectively in Bissoondial Singh, Samaroo Jailall and Prittipaul Jaigobin respectively, which prevents the former from proceeding with or submitting the said motion to be moved at the OGM this afternoon.
According to the writ, the aforesaid Motion is not a Motion of No Confidence, and in any event the nine-month period within which a Motion of No Confidence is to be presented has expired. That indeed is the only type of motion contemplated and provided for by the Constitution of the Demerara Cricket Board and the only way that the Executive Committee can be removed from office, other than by elections, is by a Motion of No Confidence in the Executive Committee which, in accordance with the said Constitution, must be submitted within nine (9) months from the date of the election of the Executive Committee at the preceding Annual General Meeting.
However, because of the numerical strength of the Respondents/Defendants and their followers, it is very possible that they can present the aforesaid Motion, and indeed any Motion, and succeed in getting the same passed irrespective of whether the said Motion complies with, contravenes, or is ultra vires the Constitution.
There is every likelihood that the Respondents/Defendants will actively pursue and successfully realise the unconstitutional and unlawful eventuality apprehended in paragraph 15 above.
As a result, the Second and Third Named Applicants/Plaintiffs and I have caused to be filed High Court Action in which we are claiming the following reliefs:
(i) a Declaration that the Motion dated the 16th November, 2009, to be moved by the First Named Defendant, in his capacity as the President of the East Bank Cricket Association, for and on behalf of the said Association, to be seconded by the Second Named Defendant, in his capacity as the President of the Georgetown Cricket Association, for and on behalf of the said Association, and supported by the Third Named Defendant, in his capacity as the President of the West Demerara Cricket Association, for and on behalf of the said Association, circulated by the said Defendants, and scheduled to be presented at an Ordinary General Meeting of the Demerara Cricket Board to be held on Friday the 4th December, 2009, at the Georgetown Cricket Club Pavilion, which Motion resolves to call upon the Executive Committee of the Demerara Cricket Board to forthwith step down and demit office and for a new Executive Committee to be elected to serve until the next Annual General Meeting, is unconstitutional, unlawful, illegal, null, void and of no effect;
(ii) an injunction restraining the Defendants by themselves, their servants and/or agents and each and every one of them whosoever and whatsoever from moving, presenting or submitting the Motion dated the 16th November, 2009, to be moved, presented or submitted by the First Named Defendant, in his capacity as the President of the East Bank Cricket Association, for and on behalf of the said Association, to be seconded by the Second Named Defendant, in his capacity as the President of the Georgetown Cricket Association, for and on behalf of the said Association, and supported by the Third Named Defendant, in his capacity as the President of the West Demerara Cricket Association, for and on behalf of the said Association, circulated by the said Defendants, and scheduled to be presented at an Ordinary General Meeting of the Demerara Cricket Board to be held on Friday the 4th December, 2009, at the Georgetown Cricket Club Pavilion, which Motion resolves to call upon the Executive Committee of the Demerara Cricket Board to forthwith step down and demit office and for a new Executive Committee to be elected to serve until the next Annual General Meeting and that the said Defendants and their servants and/or agents from moving, presenting or submitting the said or similar or like Motion until the next Annual General Elections;
