Buxton 2-man murder trial
JUSTICE Roxanne George, presiding judge in the Buxton Squence Mc Lennon / Trian Sumner murder trial, will this morning rule on defence no-case submissions.
Following the closure of the prosecution’s case by Prosecutor Mrs. Judith Girdharie-Mursalin on Monday, Defence counsel Mr. Basil Williams made no-case submissions in the absence of the jury which were replied to yesterday by the Prosecutor.
Judge Roxanne George is expected to deliver her ruling this morning.
Before the holding of the voir dire ( a trial within a trial )to hear arguments in the absence of the jury in relation to the defence no-case submissions, the judge
alerted the jury that they would be locked in the jury room from yesterday morning, while the arguments relating to law will take place in their absence..
The judge had also told the jury that in the event of her agreeing with a no-case submission, after hearing submissions from defence counsel and replies from the prosecutor, she will direct the jury to return a formal verdict of not guilty in favour of the accused.
But, if on the other hand, she disagrees with the arguments put forward, she, as a consequence, would find that a prima facie case had been made out to go to the jury; and as such, the accused will be called upon for a defence.
In that event, the substantive trial will be resumed, ending with the jury finally deciding the fate of the accused after the case had been handed over to them by the judge for their consideration and verdict.
The case began with the star witness for the prosecution, Errol Adams, called ’Dynamite’, tesifying that he and his friend Odingo Bryan had gone to Buxton Side Line Dam on January 9, 2004, to meet relatives who had recently come from abroad, when accused Squince Mc Lennon, called ’Killer’, and Trian Sumner, called ‘Tatie’, with other armed men, attacked them.
Odingo Bryan was killed in the attack, he said, while he witness (Adams) was able to escape with serious injuries.
The trial is continuing.
