HOWARD Rambarose called “Spleen”, was, on Friday, freed of the 2016 Emancipation Day execution-style killing of Orin David, after High Court Judge, Sandil Kissoon, upheld a no-case submission made by his attorney, George Thomas.
Rambarose was on trial with co-accused, Jermaine Jeffords, for the indictment which read that they killed David on August 1, 2016, at Laing Avenue, West Ruimveldt.
The state was represented by prosecutor Lisa Cave, while Attorneys-at-law Stanley Moore, S.C., and George Thomas are on record for the defendants.
After the state closed its case on Thursday, the attorneys made a no-case submission calling for the indictment to be dismissed on the grounds of insufficient evidence.


On Friday, the judge upheld the no-case submission in favour of Rambarose citing the prosecution’s failure to establish a case against the defendant. Justice Kissoon then told the jury that they have to return a not-guilty verdict against Rambarose.
However, the judge called upon Jeffords to lead his defence. During his defence, Jefford told the court that he is innocent and was wrongfully charged for the offence. Justice Kissoon is expected to sum up the evidence against Jeffords on May 24, 2021, after which, a jury will deliberate to arrive at a verdict.
David, a taxi driver, was gunned down in front of his Laing Avenue, Georgetown home, in the presence of his reputed wife and other relatives. The 33-year-old was pronounced dead at the Georgetown Public Hospital, shortly after one of five men came out of a car and pumped several bullets into him.
According to reports, minutes before his death, David was involved in an argument with a man over money. The man went away, but later returned with four other men in two vehicles and executed David.
