Open letter to the President, Leader of the Opposition

Dear Sirs,
I HAVE the honour of writing Your Excellencies as Leader of the National Independent Party.
My Party is aware of the present Constitutional crisis, and looks forward to an immediate resolution.

The National Independent Party requests/demands that Major-General (Retd) Joe Singh or Dr. Steve Surujbally or Mr. Rudy Collins be recalled and be appointed Temporary Chairman of the Guyana Elections Commission for the purpose of the holding of the imminent General and Regional Elections.

This consensus is to be submitted to the CCJ, which would be required to make an order, ‘by consent’, in respect to the appointment of a Temporary Chairman as per Article 151 (7) of the Constitution. Secondly, the no-confidence motion has been passed in accordance with the Constitution, pursuant to Article 106 (6) on December 21, 2018 required the Government to hold Elections on or before March 2109 (Article 106 {7)).

There is no extension of time as per 106 (7) by resolution of two-third majority; all acts and things done become illegal and unconstitutional. The CCJ, by order of court, must validate all acts and things done after March 21, 2019 and set a date for election as was done in the decision of Esther Pereira paragraph 3, which reads as follows: – “That fresh National and Regional Elections shall be held in the Republic of Guyana on or before the 31st
day of March, 2001.”
Accordingly, a date must be now set for Election by the CCJ.
