“THIS LADY always throwing water down on meh, and ah fed up tell de landlord pon she!”This was the lament of a woman who brought her upstairs neighbour to the courtroom of Chief Magistrate Ann McLennan.
On Monday, 50-year-old Marceline Barrow was charged with breaching the peace of her downstairs neighbor, Johanna Harvey. The incident occurred on January 1 at their Brutus Street, Agricola home.
Present in court, Harvey expressed her frustration over the matter and insisted that Barrow’s action was premeditated, since water would frequently be leaking through the floor boards into her apartment.
“She gets the children running, plus all de time ya hearing heels clacking-clacking,” Harvey told the court.
Barrow, however, seemed shocked by the woman’s claims, and was quick to clear the air. “Ya Honour, on the day in question it was New Year’s and nobody was at home, and the water came with pressure from the pump and broke the pipe faucet.”
Barrow noted that her son had to break into the apartment to stop it from flooding.
Upon hearing both sides, the magistrate informed the women of their right as tenants to have ‘peaceful enjoyment’ of the premises.
“I advise that you take the landlord to court and claim for any damages, or seek further advice,” Magistrate McLennan told Harvey, and scolded them to “live good with each other.”
Barrow was placed on self-bail and the matter was transferred to Court 12. The magistrate bonded both parties to be of good behaviour.
