THE PASTOR of the Georgetown Nazarene Church was yesterday fined $100,000 after he was found guilty of causing death by dangerous driving by Chief Magistrate Ann McLennan.Winston Cramer of 162 Go Slow Avenue, Tucville, also an International Development consultant and a lecturer at the University of Guyana was found guilty of the charge which stated that on April 10, 2014 at Camp and Quamina streets he drove motor car PKK 7896 in a manner dangerous to the public, thereby causing the death of Lennox Allicock.
The Chief Magistrate, before making her ruling, ordered a probation report, which was heard yesterday in open court.
It was said that Cramer was raised by a single mother in a Christian home and was the third eldest child. He is the sole bread winner and is the father of two teenagers.
The report further revealed that Cramer was remorseful of his actions and even offered to compensate the dead man’s daughter in the sum of $500,000.
The probation officer urged the magistrate to consider Cramer’s upbringing, career path and his life-style, before passing sentence.
Cramer’s lawyer Nigel Hughes pleaded to the court that his client was deeply remorseful that because of the accident a father of a young girl was lost and to place weight on his client contribution to society.
Hughes also asked the magistrate to be mercifully since Cramer’s wife was mentally challenged and was solely dependent on her husband also.
The magistrate asked Allicock’s wife if she would accept the compensation but the woman refused.
The woman declined the $500,000 offer since she felt that was a small price to pay for the loss of her husband, plus the suffering and pain her daughter endured since she was on the bike being towed by her father
The woman signified her willingness to accept a $1.5M compensation to which the lawyer Hughes quickly replied that his client would willingly settle.
After a lengthy mitigation, the chief magistrate ruled in her sentencing that she had noted that a life had been lost, the seriousness of the charge and the compensation offered.
The pastor must pay a $100,000 fine or serve a sentence of 18 months in jail.
According to facts presented in court, on the day in question, around 16:00 hours, Cramer was proceeding east along Quamina Street, and failed to stop at the intersection at Camp Street, thereby causing a collision.
Allicock, who was on the northern side of Quamina Street, was struck down. Two other persons who were with him received injuries. He was rushed to the Georgetown Public Hospital Corporation (GPHC) where he succumbed to his injuries a few days later.
