Scuffle over television leads to assault charge

TWENTY-SIX-YEAR-OLD labourer Marvin Budener was before Magistrate Zamilla Alli, at Cove and John Court, on Friday, January 3, charged with assault.Particulars of the offence said the defendant, on Wednesday, January 1, 2014, at Haslington, also on East Coast Demerara, unlawfully assaulted Robert Smith so as to cause him actual bodily harm.
Budener, who was unrepresented by counsel, said, that day, he had gone home to watch television but the antenna was giving some trouble and he opted to have it fixed.
He added that, after fixing the problem, he proceeded to his living room to enjoy the clear view of the transmission but, while powering the set, Smith unplugged the TV and told him he cannot look at it.
Budener said he retreated to his bedroom but was followed by Smith who continued to accost him and that led to a scuffle between them.
Budener said a glass bottle that was nearby fell and broke in the process, resulting in Smith suffering his injuries.
After listening to the defendant‘s narrative and the Police facts, the magistrate out him on $30,000 bail and set January 28 for report.
