In wounding case… : Common law wife not allowed to withdraw charge

PETER Austin, of Lot 15 ‘A’ West Front Road, Georgetown, was remanded to prison yesterday when he appeared before Chief Magistrate Priya Sewnarine-Beharry on a wounding charge.The defendant pleaded not guilty to the offence, particulars of which said that on Wednesday, October 23, at his address, he unlawfully and maliciously wounded Gailann Sandy.
Police Corporal Bharat Mangru, prosecuting, said the virtual complainant and defendant are a common law couple who had a misunderstanding and the man became annoyed and dealt the woman a cuff to her face and several kicks about her body.
Attorney-at-law Mr. Paul Fung-a-Fat, for the defendant, indicated that Sandy does not wish to proceed with the case against Austin, who is the father of her six children.
She said their relationship is about eight to nine years old and does not wish to give evidence.
But the Chief magistrate informed her that she is compelled to do so and refused Austin bail until November 4.
