“Acting from fear, I collected a piece of wood which was at my hand-reach, and jumping to my feet, I fired a blow at Daniels and ran away, because I was fearful of my life.
“I am asking this court to give me a second chance,” the accused said in an unsworn statement from the dock yesterday.
This statement, representing the defence in an unsworn statement from the dock to mark the beginning of his defence, was made after Prosecutrix Miss Natasha Backer closed the case for the prosecution.
The chubby Amerindian accused is being represented by Attorney-at-Law, Mr.Keavan Bess, who earlier made a successful submission to get rid of an alleged confession statement said to have been given by the accused to the police.
That alleged confession was thrown out of the evidence following the holding of a voir dire (a trial within a trial) conducted by trial judge, Mr. Navindra Singh, in the absence of the jury, to decide on the question of admissibility of the statement.
This morning, counsel for the defence will address the jury by telling them of his opinion of the evidence which, if adopted by the jury, the judges of facts could result in a verdict of acquittal.
On the other hand, the prosecutrix will deliver her final address to the jury when she would exhort them to find, from the evidence led, that the prosecution had established a prima facie case against the accused.
After both counsel would have addressed the jury this morning, Presiding Judge, Mr. Navindra Singh will sum up the evidence to the jury, and hand over the case to them for their consideration and verdict.
Murder accused will know his fate today
