Witness unwilling to return to complete evidence after collapsing under cross-examination : – court’s permission being sought to have witness’s deposition tendered

ON the resumption of court yesterday, the prosecutor in the murder trial of Marlon Braithwaite of Bare Root, East Coast Demerara, told Justice James Bovell-Drakes and the jury that the witness Joycelyn Montague Adams had expressed her unwillingness to return to complete her evidence. Consequently, it has been learnt that the prosecution is to take certain steps to seek the court’s permission to have the witness’s deposition tendered in evidence under Section 95.
Counsel for the defence, Mr.  Bernard De Santos, S.C. told the judge that he would have no objection to the action of the prosecution as long as justice would be served.             
In the meantime, the witness who had collapsed in court while being cross-examined by the Senior Counsel on Tuesday and had to be taken to the Georgetown Public Hospital has been treated and sent home.
In order to give the prosecution an opportunity to put their act into action, the judge adjourned the court to Monday April 22nd.
Braithwaite is accused of killing his lover Sharmin McKay on June 15th 2009.  
Prosecuting in the case are Mrs. Tashana Lake and Miss Dhanika Singh.
