JUSTICE Roxanne George and a mixed jury at the Demerara Assizes yesterday heard a story about a quarrel and a fight between Kenrick James and George Adams that led to the death of Adams on August 13th, 2007, from a blow with a chair.
James is being represented by defence counsel, Mr. Compton Richardson.
State Prosecutor, Miss Rhondel Weever who in association with attorney-at-law, Miss Natasha Backer is conducting the case for the prosecution, assured the mixed jury that she would lead evidence to prove that the killing was unlawful.
According to her, in an attempt to prove its case, the prosecution must provide the jury with enough evidence so that they feel sure that all the elements of the offence of manslaughter are established.
Those elements, she said, are that the accused James did an unlawful and dangerous act, and when he did, Adams received an injury; that Adams died as a result of that injury; that Adams died within a year and a day of receiving the injury; and when James did that unlawful and dangerous act he had no legal provocation.
Relating the facts of the case, the prosecutor disclosed that on the 13th August, 2007, the accused and the deceased were both clients of Phoenix Recovery Project Drug Treatment Programme at Sparendaam, East Coast Demerara.
While at the institution between 14:30 hrs and 15:00 hrs on the same day, an argument ensued between Adams and James.
During the argument a fight ensued and it is the State’s case that while Adams was unarmed, the accused with the use of a wooden and steel chair, did an unlawful and dangerous act which resulted in Adams receiving an injury to his left chest, just below the armpit which resulted in his death.
Adams was taken to hospital by the accused and another person in a taxi driven by Farouk Baksh. He was pronounced dead at the hospital.
According to a post-mortem examination, the cause of death was the perforation of the lung due to a punctured wound to the left chest just below the armpit.
It is the State’s case that the accused gave a statement to the police outlining the circumstances in which he inflicted the injury on Adams. The hearing is continuing.
