SATASH Singh and Parsram Lachand, called ‘Desmond’, two of six men who are alleged to have beaten 58-year-old Niranjan to death in July 2008, will know their fate today.Three of the accused have already pleaded guilty to the lesser count of manslaughter, and have given the prosecution assurance that they would speak the truth in relation to their alleged partners in crime; they have so far each been sentenced to 15 years’ imprisonment.
It is up to the prosecution and the jury to decide whether their testimonies, given yesterday, have been helpful.
Following their individual testimonies yesterday, defence counsel and prosecutor each addressed the jury, urging its members to return certain verdicts. The defence called for a not-guilty verdict, and the prosecution asked for a verdict of guilt, in accordance with the evidence and the oath members of the jury had taken.
This morning, Justice Navindra Singh is expected to sum up the evidence to the jury, after which he would hand over the case to them for their consideration and verdict.
The six accused are Vishal Singh; Vishnu Singh; Akash Singh (14); Babzie Singh (father of Vishal, Vishnu and Akash); Satesh Singh; and Parsram Lalchand, called ‘Desmond’.
When the trial was first called, some days ago, three of the accused — Vishal, Vishnu, and their father Babzie — pleaded guilty to the lesser count of manslaughter; and reportedly also entered into an agreement with the prosecution to speak the truth as witnesses for the prosecution.
Two of them testified yesterday, as promised. Whether the testimony was helpful is a matter for the jury to decide.
The trio had decided to tell the truth about the attack that had left Niranjan with a fractured skull, damaged brain, and broken bones.
Of note was that the DPP had entered a nolle prosequi (withdrawal of the charge) against 14-year-old Akash.
On the other hand, Vishal, Vishnu and Balzie were each sentenced to 15 years’ imprisonment, while their partners in crime — Satesh Singh and Parsram Lalchand, called ‘Desmond’ — who have pleaded not guilty, are facing trial for the capital offence.
They will know their fate today.
