Mon Repos Sunday night smash-up : More than half million in bail for teen driver : Prosecutor, police modus operandi upsets magistrate

SEVENTEEN-YEAR-OLD Gidram Rasiawan was yesterday slapped with five charges when he appeared in the Sparendaam Magistrates’ Court. The charges were in addition to the driving under the influence charge which he was charged with and for which he had received bail in the same court on Monday. altYesterday the teen appeared before magistrate Alex Moore where the additional charges were read to him. The new charges are breach of insurance; being an unlicensed driver; taking a vehicle without the owner’s consent and two counts of causing death by dangerous driving.
The magistrate granted the teenager $50,000 bail each for the offences of unlicensed driving, breaching of insurance and taking a vehicle without the owner’s consent. Those charges carried a total of $150.000. In addition, he was granted bail in the sum of $300,000 each for the two counts of causing death by dangerous driving.
The additional charges racked up a bail amount of $750.000. However with that amount and the bail which the young man was required to post for the offence of driving under the influence, the grand total amounted to $757.500 in bail for all the offences for which Rasiawan committed on Sunday when he slammed into a minibus loaded with passengers.
Yesterday the teen was represented by attorney at law Mr. Hukumchand who asked that bail be granted in a reasonable sum. The prosecutor objected to bail while stating to the court that eight persons were still patients in the Georgetown Public Hospital. However his request was refused after the magistrate asked the prosecutor if the still hospitalised persons were out of danger, and was told that they were.
The magistrate further stated that he was not willing to allow this incident to prevent the teenager from completing his schooling. He is expected to sit the Caribbean Secondary Education certificate (CSEC). He is presently a student at School of the Nations.
The young man was required to lodge his passport with the court and will appear in court again on April 4. He was also ordered to report to the Providence Police Station between every Saturday until the matter is complete. Gidram Rasiawan lives at 15 Eccles with his parents.
Yesterday the teen was surrounded by mostly young people and his parents. It was yesterday also that Magistrate Alex Moore repeatedly questioned the prosecution and the investigating ranks in the matter of why the young man was before him again just two days after he appeared in the court for the driving under the influence and for which he has received bail in the sum of $7,500.
The magistrate stated that because the police brought “the smaller piece of a bigger puzzle”, there is the public perception that the magistrate, although two persons were killed in the accident, granted the driver only $7500 bail.
However that amount was  granted only for the driving under the influence charge, and when the matter was dealt with in the court, the prosecution and ranks did not inform the magistrate that the teen was  likely to have other charges stemming from the accident.
