A COURT matter between Trade Unionist Carvil Duncan as plaintiff and Quenella Griffin as defendant, in a dispute involving land at Plantation Great Diamond, East Bank, Demerara, has been fixed for hearing on September 10. Griffin is reputedly trespassing on land claimed by Carvil Duncan. According to Duncan’s statement of claim, he is the owner of Lot number 1189 Section ‘B’ Block X, Great Diamond, EBD, together with the building and erections thereon. The defendant, Quenella Griffin of the same address, has occupied the property as a trespasser to the plaintiff’s predecessor in title – the New Building Society Limited.
The New Building Society Limited filed civil action No. 870-CD 2008 against the defendant; and on January 7, 2009, Justice Rishi Persaud ordered that the defendant deliver up vacant possession of the property to the NBS within 14 days of the making of the order.
The defendant refused to comply with Justice Persaud’s order.
On March 30, 2009, the NBS filed ex-parte application against the defendant, seeking writ of possession.
On July 9, 2009, the NBS was granted a writ of possession directing the High Court Marshal to remove from the property the defendant and all other persons in actual possession of the property.
After Duncan obtained possession of the property, he made several requests and demands of the defendant to hand over the property, but the defendant failed and/or neglected to so do.
He is consequently claiming against the defendant vacant possession of the land and building, as well as mense profit in the sum of $25,000.00 per month from July 2011, and continuing.
