De Santos seeks injunction to get defendants off Essequibo land –hearing fixed for September 3

DEFENCE Counsel, Bernard De Santos, S.C. is seeking among other things an injunction to get three defendants to vacate Parcel 687 Good Hope, Essequibo, which plaintiff Alvin Bishop, a boat builder of Good Hope, Essequibo Coast, is claiming from defendants Nelta Sandiford, Rolex Sandiford and Troy Theophat on the ground that he had been in continuous occupation of the land for over 12 years. Bishop claims he has completely fenced the land with barbed wire fencing.
The plaintiff filed an application in the Land Court since 1999 seeking declaration of Title to the said Parcel 687.
That application is unopposed, but according to the plaintiff’s counsel, Mr. Bernard De Santos, S.C., the process has not yet been finally concluded.
On the 21st October, 2011, there was a confrontation on the said land when the second-named defendant, Rolex Sandiford, on his motor cycle, is said to have approached the plaintiff and communicated his intention to destroy the barbed wire fencing by tearing it down.
According to the plaintiff, the said defendants, Nelta Sandiford, Rolex Sandiford and Troy Theophat, proceeded to execute the threat on the barbed wire fencing by tearing down over 400 feet thereof, and erecting a fence within the plaintiff’s fence.
On Sunday, 14th July, 2012, there was no structure erected on the land by the defendants, although it had been fenced off.
On 22nd July, 2012, the plaintiff visited parcel 687 Essequibo and observed the preparation of a structure on the said parcel.
The defendants were observed on the land, along with a group of persons unknown to the plaintiff, preparing the said structure.
The defendants have no title, right, or colour of right to possession of the said parcel of land, and are brazen trespassers thereon, according to the plaintiff.
They have refused to remove the structure off the land, despite the plaintiff’s demand made, and their receipt of prepaid registered notice that they do so before November 20, 2011; and they are still trespassing upon the plaintiff’s land.

The plaintiff has therefore approached the court seeking the following reliefs:
(1)   Damages in excess of $50,000.00
(2)   An order that the defendants immediately vacate Parcel 687 Good Hope, Essequibo, and remove all their structure therefrom, and give up immediate possession to the plaintiff.
(3)   An injunction restraining the defendants, their servants and/or agents from entering upon the land, Parcel 687, damaging the fence thereon.
(4)   Writs were issued on the plaintiff’s behalf by Mr. Bernard De Santos, S.C. and Mrs. Pamela De Santos.
