THE Full Court, constituted by Justice James Bovell-Drakes and Justice Dawn Gregory, will deliver its decision in relation to the appeal motion involving the Guyana Cricket Board and the Interim Management Committee, regarding the alleged seizure of commodities, on July 10. The matter between the D.E.B Essential Organisation Inc., as plaintiffs/applicants, and the Attorney General of Guyana and the Minister of Culture, Youth and Sport, was heard in the High Court yesterday, and certain documents were submitted to the court for consideration.
By way of ex-parte summons dated March 15, 2012, and affidavit in support by Anand Sanasie and Fazul Bacchus on behalf of D.E.B Essential Organisation Inc., and refused by the Hon. Chief Justice Ian Chang, S.C., on March 15, 2012, the plaintiffs/applicants are asking for the following reliefs to be granted, that is to say:
An Order staying the performance and/or execution of any of the rights, functions and obligations of the Guyana Cricket Board by the Interim Management Committee, comprised of Clive Lloyd, Alfred King, Norman Mc Lean, Anthony Xavier, Edward Luckhoo, Harry Ramasar, Anil Beharry, Keith Foster and Bissoondyal Singh, as appointed by the second named respondent, the Hon. Minister of Culture, Youth and Sport, until the hearing and determination of the Constitutional Motion herein.
There was an Order for the return to Chetram Singh, Lionel Jaikaran, Ramsey Ali, Fizul Bacchus, Alfred Mentore, Anand Sanasie, Dru Bahadur, Anand Kalludeen, Collin Europe, Troy Mendonca, Terrence Holder, Rayon Griffith and Nazimul Drepaul, the defendants in the originating summons, application # 130-SA of 2012 Demerara within 48 hours of all books, records, computers, computer hard drives, flash drives and any other media whatsoever; computer records, cheque books, deposit books, accounting records, minutes of meetings, correspondence received and copies of correspondence dispatched, used by, or for the credit or use of the purported Guyana Cricket Board; and any documents or records relating to any of the items as aforesaid, or to any goods, chattels, cash, funds held in bank accounts, movable and immovable property whatsoever, received and or seized from the premises of all or any of the aforesaid named defendants in the originating summons, application # 130-SA of 2012, Demerara.
