Chief Justice issues Nisi Order…

Registrar of Deeds to show cause why 9 transports not passed
ATTORNEY-at-Law Saphier Husain was yesterday granted a Nisi Order by Acting Chief Justice Ian Chang, on behalf of 9 applicants, compelling the Registrar of Deeds (Ag.) to show cause why an Order for a Writ of Mandamas should not be issued to compel her to pass transports to nine applicants from Fair Field Investments Limited.
The applicants are Leonard Veerasammy, Toolawiti Ramsammy, Kalawattie Saitram, Cleavland Ramsammy, Mohan Nonelall, Gonwantie Ramkaran, Bhulaik Kham, Ganga Bhadur & Mohsn Bissoon.
The Originating Notice of Motion had asked for an Order or Rule Nisi of Mandamas be directed to the Registrar of Deeds (ag.), Law Courts Compound, Georgetown, a statutory body under Deeds Registry Act Cap 5:01, to show cause why an Order for Writ of Mandamas should not be issued to compel the Registrar of Deeds (ag.) to pass transports to the applicants from Fair Field Investments Limited as follows:

1.   Fair Field Investments Limited to Leonard Veerasammy, Lot 18, being a part of a piece of land of Plantation Fair Field situated in Little Courabanna, on the East Coast Demerara, as advertised in the Official Gazette dated 30th September  2006 as No. 36.
2. Fair Field Investments Limited in Toolawiti Ramsammy – Lot 7, a part of a piece of land of  Plantation Fair Field situated at Little Courabanna, on the East Coast of Demerara, as advertised in the Official Gazette dated 30th September 2006 as No. 26.
The motion had also sought an Order that the Applicants serve on the Registrar of DeedS (ag.) a sealed and certified copy of the Motion, together with Affidavit in Support, together with certified copy of this Order sought in paragraph (a) and herein within seven days.
And further, take notice that the grounds for this application are as follows:
That the Registrar of Deeds (ag.) has violated the Constitution of Guyana 1980, Article 142, and acted in excess of her jurisdiction, and failed to carry out her Statutory duty by refusing to pass transports to the applicants, which were filed by Fair Investments Limited since 2004.
The Nisi Order by the Chief Justice calling on the Registrar of Deeds to show cause why she should not be compelled to pass the transports was entered yesterday.
