THE murder case in which two accused were freed and another got a seven- year prison sentence, through plea bargaining, will continue Monday with only the fourth man still on trial. On the resumption, before Justice Dawn Gregory, the last witness for the prosecution is to be called, to testify against accused Burt Lancaster.
The prisoner, Daywan Kawal called Avinash’ is now a witness for the prosecution against Lancaster, called ‘Moses’.
Kawal was the number one accused when four of them were committed to trial after the preliminary inquiry (PI).
Defence counsel Basil Williams had, on behalf of Lancaster, filed a constitutional motion with the hope of halting action against the latter, but it has not yet succeeded and he is now alone in the dock.
Appearing for the State are Ms. Konyo Sandiford and Ms. Diana Kaulesar.
The prosecution’s narrative is that on April 19, 2006, Lancaster and Kawal went to the taxi stand at Diamond, from where they hired a vehicle to take them to Soesdyke, also on the East Bank of Demerara, to have a drink with two friends.
During the course of the journey, the driver, Deonarine Sukhdeo stopped at a gas station and, while he was out of the car, Lancaster suggested that they rob him and Kawal agreed. They then asked him to take them along a trail to Kuru Kuru, along the Soesdyke/Linden Highway, where they inflicted injuries on him, robbed him of his vehicle and cell phone and abandoned him.
The injured man died sometime between April 19 and 26, 2006 and a post mortem examination revealed that death was due to multiple stab wounds.
