Voir dire to determine alleged confession statements
JUSTICE Winston Patterson, the presiding judge in the Enterprise murder trial involving the two accused, Kennise Glasgow called ‘Zachery’ or ‘Juma’ and Dexter Headley called ‘Mas’, for the murder of Davechand Appanna, is conducting a voir dire (a trial within a trial) to determine the admissibility of two alleged confession statements. Kemrajie, the star witness for the prosecution, had told the mixed jury how three armed men, whom she did not recognize, had attacked her home at Enterprise on August 17, 2004, demanding money and jewellery.
According to her, “After they knifed my husband to death, I heard my husband shout, ‘Oh God ah dead’.”
Then the witness admitted under cross-examination by leading defence counsel, Mr. Basil Williams, that because of the chops which she received on her head, she was rendered unconscious by the blows and only regained consciousness on the hospital bed.
Later, leading prosecuting counsel, Miss Teshana James-Lake, was attempting to put in evidence, two alleged confession statements, when counsel for the defence, Mr. Williams and Mr. Max McKay and Ms. B. Glasford, objected on the grounds that the statements were not obtained in accordance with the judges’ rules.
The hearing is continuing.
