Prosecution seeking to lead additional evidence
PRESIDING Judge, Justice Roxanne George, in the Farm wedding house attempted murder and grievous bodily harm case, will this morning  rule whether or not the prosecution has the right to lead fresh medical evidence to clarify doubtful testimony of a doctor who is out of the jurisdiction.
The prosecutors, Miss Konyo Sandiford and Mrs.  Judith Gildharie-Mursalin, had set out to lead evidence to prove that the accused, ‘Baby’ and ‘Rocky’ , wounded Ramnauth Sukhnandan at a wedding house brawl in 2006 with intent to murder him or to maim and disable him.
It is alleged  that accused Naresh Singh, called ‘Baby’, and  Mohan  Harriram, called ‘Rocky’, wounded Ramnauth Sukhnandan with intent to murder him.
But during the trial, under cross-examination by defence counsel, it came out in evidence  that the virtual complainant  had suffered injuries to the head in an earlier matter  and that it was  doubtful  whether  the injury  the doctor was referring to in the certificate related to the old or new injury.
As a consequence, the prosecutors applied for permission to call a doctor to clarify the terms in the certificate, and this was objected to by defence counsel Mr. Jailall Kissoon, Mr. Adrian Thompson and Mr. Satesh Kissoon.
The judge  conducted a voir dire (a trial within a trial) in the absence  of the jury and the question of law involved was discussed.
The arguments concluded yesterday when the judge reserved her ruling on the point to this morning.
