JUSTICE Dawn Gregory, the presiding judge in the Vlissengen Road murder case, will today rule on the defence no-case submissions.
At the close of the prosecution’s case by lawyer, Teshana James yesterday, defence counsel Mr. Ronald Burch-Smith, representing accused Rayburn Harvey, elected to make no-case submissions in the absence of the jury. Both prosecution and defence lawyers addressed the judge in the voir dire (a trial within a trial).
The judge is expected to deliver her ruling this afternoon.
In her opening address to the jury, the prosecutor assured the judge and jury that she would lead evidence to prove that the accused had shot and killed Samantha Belle on the night of March 18, 2006.
Evidence, she said, would be led to show that the accused either intended to murder or to cause grievous bodily harm. The prosecution will also contend that the question of accident does not exist.
