Delayed charge resulted in sisters being freed

Two sisters, Abigail and Esther Cadogan walked out of the Vigilance Magistrate’s court a free duo after it was discovered that a charge laid against them by Police since the 5th September 2010 was only brought before the court on Thursday 17th March, 2011.

The charge had stemmed from an incident which occurred between the sisters and a Mr. Basil Assanah.

Magistrate Shurdel Isaacs-Marcus explained to both defendants and the Virtual Complainant that the matter has already passed its six (6) months stipulated period. And as such, she cannot proceed with a trial.

Mr. Assanah then told the court that the police had more than enough time to bring the matter to the court much sooner, and that he was dissatisfied with the way the police had handled the investigations from the inception.

The Magistrate, nonetheless, reiterated that there is nothing else she could do, as legally she cannot proceed.

The defendants were relief to hear that they are free to go, while the VC kept repeating that the police had done a grave injustice to him.
