Two accused in ‘duck thief’ murder case freed by jury

TWO men  of Grove East Bank, Demerara, Andy Jagmohan and Jainarine Persaud, who were freed by a Demerara Assize jury of beating alleged ‘duck thief thief’ Audie Peters to death in January, 2008, have been discharged by presiding judge, Winston Patterson.
It was a case in which one alleged  eye-witness, Mohamed  Ali, called ‘Bruck-Up’, a man with a questionable character, according to the defence, testified that he saw the two men beating  Peters  with a piece of wood and with an iron rod.

And, according to him when he rebuked them for beating the man who could die from the blows, one of the attackers said, “Let me kill him, he thief meh duck.”
On the other hand, a prosecution witness, Radica, who was made available for the defence, since the prosecution did not wish to make use of her testimony, testified that she lived in the street where the incident occurred, and that she was absolutely sure that the accused were not the killers.
In answer to defence counsel Mr. Khemraj Ramjattan, who had appeared in association with lawyer Persram for both accused, said “After I was awakened by noise that night I arrived on the scene before the accused.   I know this because when I saw the man lying on the parapet and groaning, I saw the accused open their doors and proceeded to the scene where my husband and I were standing”.
Continuing, witness Radica said that later a Policing Community Group vehicle turned up on the scene and took the injured man to the police station and the hospital, where he later died.
The prosecution was conducted by Miss Teshana James, in association with Miss Rhondel Weaver.
