AS a Guyanese who always complies with the laws of this country, and as one who respects the laws of the land in every aspect, especially edicts of the court, such as Court Orders, I find it most heartening that His Excellency, President Dr. Bharrat Jagdeo has assented to the law which now criminalises contempt of court. Too many people have been making mockeries of injunctions, thinking it was a big joke, and despite having an order of the court issued against them, they continue in their merry way, disturbing people with useless and unwanted noise coupled with baseless vulgarities. Others just refuse to respect court orders.
I have written much and talked much on television on this. Because the laws governing contempt of court was weak, hence, many just treated it as hogwash. Sadly, I know for a fact, that some lawyers actually instruct their clients to disobey the court order. I wonder if they will now still advice their clients to disobey court orders. Some deceitful lawyers even advise their client wrong just to make money, knowing some cases have no merit and no basis.
I have had a Court Order issued against the owner of an entertainment facility for noise nuisance on May 16, 2009. Notwithstanding, the proprietor continued with dozens of shows, publicly declaring that the shows will go on, even though charged by the police also, and despite being served with a Court Order, supported by several prominent citizens of Atlantic Gardens.
The case was won by the police and me, the complainant. The learned Magistrate made some serious pronouncements, including that it is the District Magistrate which has to give permission, inclusive of other legal institutions. Not any magistrate. The person charged was found guilty and fined $14,500. A Small fine, but extremely symbolic for Guyanese who require peace and quiet. The contempt of court proceeds in the High Court.
We are now moving to another contempt of court action, but this time against a promoter, the owner of an entertainment facility and all the sponsors (some of whom are my friends, but they should know better and do better), and owner of the sound system, of the last show held at Starlite Drive-Inn on 6th Nov., 2010. That was definitely the loudest (Travellers), the most vulgar, most immoral ever in history. Until 2 am we had to bear this disgraceful show.
Imagine the Trinidad DJ (Afro-TT) saying to another decent male performer, “Me Want push me tongue up you naneee (grandma). To us Indians ‘nanees’ are holy people, almost Godlike and pure. But the Indo-Guyanese audience loved it. That performer said it was Diwali and he was fasting, but the dirty man insisted. Then he said, all you East Coast ladies (meaning Indian women): “alyou like stamp, you all like to get lick before you get stick!) in the presence of children at the show, with children in the community in their homes, and decent people. He went on: Holla Yeah, and all the Indian women did holler yeah. Then he went on insulting the Indo-Guyanese women there, and they seem to love it: “a want wan ayuu to tek off ya panty and brazzier and come up hey!!
Moral and decent citizens of Guyana, this is what Guyanese have to bear. The Guyanese artistes were loud yes, but never so vulgar. It is always the imported vulgar Trinidadians and their dirty chutney. The sad news is our decent people are getting to like it also, and allowing outsiders to insult their wives and daughters. The Trinidadian beer importing giant love this, as does the local, because this nastiness help their sales, while destroying our people and our future. Same for the rum companies.
I congratulate the Government of Guyana and the President on working hard to make Contempt of Court a criminal affair. It is now time to reign in the vulgar and lawless.
