PARTIES in a property dispute that has engaged the High Court for some 14 years finished giving their evidence on Wednesday and legal submissions, to Acting Chief Justice Ian Chang, are expected to follow. The plaintiffs, Rajkumarie Permesar and Kowsilla Permesar, through their duly constituted attorney Tameshwar Bovil also known as Tamesah are represented by Mr. Joseph Harmon and Mr. Rajkumar.
The statement of claim is that the plaintiffs own, by transport, Block ‘U’, part of Plantation Peter’s Hall and Providence, in the Eccles/Ramsburg Village District, East Bank Demerara.
The defendant, Toolsie Persaud Limited, is alleging that on February 13, 1980, the plaintiffs sold and transported the land to Guyana Sugar Corporation (GuySuCo).
The company said another portion of the property was compulsorily acquired by the Government of Guyana which paid compensation to the plaintiffs, to facilitate the construction of the Demerara Harbour Bridge and, after then, continued in possession and occupation of the remaining portion of Block ‘U’.
Litigation over the land was maintained through various court actions before two other judges and a Commissioner of Lands and Surveys and the plaintiffs are now asking for:
* damages and pecuniary compensation, in excess of $7M, for trespass committed by the defendant on the land described as Block ‘Ú’ of Plantation Peter’s Hall and Providence;
* an injunction restraining the defendant company, by itself, its directors, officers, servants and or agents and workers from entering upon or working on the land;
