Magistrate overrules Police objection as lawyer alleges torture

MARK Washington, Sheldon Booker and Junior Vieira (no addresses given) have been jointly charged with break and enter and larceny. The trio appeared before Acting Chief Magistrate Priya Sewnarine-Beharry yesterday, accused of having, between September 25 and 26, broken into the storage bond of Wollyea Anderson and stolen one electric drill, one nipper and other things valued a total of $585,000.
They all pleaded not guilty to the allegation and Booker denied, as well, that, on October 28, he had 20 grammes of cannabis (marijuana) for the purpose of trafficking.
Police Sergeant Lionel Harvey, prosecuting, had objected to bail for the defendants and said, among other things, that Washington resisted arrest and scuffled with a policeman.
But the Court overruled the objection and granted the men $100,000 bail each, although Booker was remanded to prison on the narcotic charge, until November 22.
Attorney-at-law Mr. Ronald Burch-Smith, for Washington, said the defendant was travelling in a mini-bus when Police stopped the vehicle, ordered him out and beat him severely about his body.
The lawyer also alleged that the Police tied Washington’s private parts with a piece of rope and pulled it and placed a black plastic bag with some toxic substance over his head to get information from him.
Submitting that whatever the man said was due to force being applied to him, Burch-Smith requested the magistrate to note visible injuries on Washington.
