Sol Inc. wants Sheik Yusuf to vacate Ogle Service Station

Sol Guyana Incorporated wants Sheik Yusuf to vacate the Ogle Service Station.
A writ to this effect was filed in the Supreme Court Registry yesterday by Sol Guyana Inc. ,
resulting in Judge Winston Patterson  hearing an ex parte application,  that sought damages from Yusuf in excess of $50 M and an interim injunction.
The injunction seeks to restrain the latter from remaining at the service station at Khan’s Park, Ogle, East Coast, Demerara.
Justice Patterson granted the defendant seven days within which to file an affidavit in answer with the right of the plaintiff to file a reply if necessary.
The hearing was fixed for August 10, 2010.
Senior Counsel Mr. Rex H. Mc Kay and Mr. Neil Boston, Attorneys-at-law appeared for the plaintiff.
In  his affidavit in support of application for interim injunction,  Mr. Ken Figaro , of lot BB Rome (Agricola) Greater Georgetown, sworn that he is the General Manager of the plaintiff company since February, 2005, and has been duly authorized by the Board of Directors of the plaintiff company  to swear to the affidavit on the plaintiff’s behalf.
According to Figaro, the  plaintiff has been duly authorized  by the Board of Directors to institute the proceedings  herein against  the defendants and as such he filed the action claiming:
(a)   A declaration that the defendant  is no longer entitled to remain on the plaintiff’s service station at Khan’s  Park, Ogle, East Coast, Demerara, after the effective date of termination of the said contract  by the plaintiff  on the 15th May, 2009;
(b)    An order directed to the defendant to deliver up to the plaintiff possession of the said service station at Khan’s Park, Ogle, East Coast Demerara, together with the buildings, fixtures, fittings, plant and equipment thereon and therein.
(c) Damages in excess of $50, 000,000 for trespass by the defendant, his servants and agents and workmen, on the plaintiff’s property at Khan’s Pak, Ogle, East Coast, Demerara.
(d) That the defendant operated a service station at Ogle under a Shell Franchise Dealer Agreement with Shell Antilles and Guianas Ltd. (SHELL) The Agreement was for the period 1st December, 1996, to 31st December, 2003.
