Prosecution closes case in Dairy Bar murder trial

Defence makes no-case submissions – Prosecution to reply
PATHOLOGIST  Dr. Nehaul Singh told the judge and jury in the Dairy Bar murder trial that the gun shot injuries he found during the post mortem on the body of Security Guard  Noel Jones were consistent with the deceased being hit by one bullet and not two.

Earlier the star witness for the prosecution who testified that while she and others were lying on the ground on the orders of  three men, one of whom was armed with a gun, she heard  two explosions – “Bang –Bang”.  Later she observed that the Security Guard Noel Jones had been shot to death.
The witness, Anmalisa Caesar, 23 , said that she had recognized the accused since she was ten-years-old by means of a scar on the face. She also said that on the night of December 6, 2006, she identified him as the man she knew when she was ten-years-old. He was the man armed with the gun that night. When she knew him at the age of ten, he had a birth mark on his forehead. They had gone to school together.
But later in her evidence, under cross-examination by Mr. Bernard De Santos, SC.,  She said that the man with the gun was  five feet, three inches tall.
However, on being measured by the Marshall in the well of the Court, on the instructions of the judge at the request of Mr. De Santos, the accused was found to be  5 feet ten and a half inches.
At this stage, the witness admitted that she might have made a mistake in respect to the accused’ height.
After the doctor concluded his testimony yesterday, State Prosecutor Miss Shivani Balcharan closed the case for the prosecution, following the testimony of six witnesses.
At this stage, Mr. De Santos elected to make no-case submissions in the absence of the jury, indicating to the judge that he would like to make submissions on the law that there is no case for the accused to answer.
Miss Balcharan began her reply yesterday and is expected to conclude this morning.
