Legal arguments in Sumner bail bid March 17

LEGAL arguments are to begin, before Justice Roxanne George-Wiltshire,  March 17, on the constitutional motion by Cheryl Sumner seeking bail for her son, murder accused Trion Sumner. The action was triggered after the prisoner had secured pre-trial liberty from Justice James Bovell-Drakes but denied his freedom by Justice Dianna Insanally, on an objection by the Director of Public Prosecutions (DPP).

Consequently, attorney-at-law, Mr. Basil Williams is seeking to have the bail grant enforced under Article 153 of the Constitution.

The lawyer is asking that the prisoner be released either unconditionally or upon reasonable conditions, including, in particular, such as are reasonably necessary to ensure that he appears on a trial date in accordance with Article 139 of the Constitution.

Williams also wants the Court to award the detainee damages for breach of his fundamental rights guaranteed  under Articles 40, 139 and 144 of the Constitution.

A copy of the summons was also served on Justice Bovell-Drakes and other attorney-at-law Mr. Fitz Peters will intervene on his behalf. (George Barclay)
