OPPOSITION Leader, David Granger has appealed the decision by Acting Chief Justice, Ian Chang to exclude him as a defendant in the Budget cut case.
Granger’s team of lawyers, headed by Senior Counsel, Rex Mc Kay and including Mr. Basil Williams and others, the Leader of a Partnership for National Unity (APNU) has filed a notice of motion, seeking to set aside the January 19 ruling.
The appellant is also asking for an order to stay the proceedings in that 2012 action until the hearing and determination of the review.
Granger is contending that the refusal to hear the appellant/second-named defendant was contrary to natural justice and Article 148 (8) of the Guyana Constitution.
In his supporting affidavit, Granger also said that, at the time of making the order, the judge waived his immunity under Article 177 (2) of the Constitution.
The litigation has its genesis in the Opposition cutting a significant portion of the 2012 National Budget.
