JUSTICE Dawn Gregory will rule, on Monday, whether or not to admit in evidence the depositions of two absent eyewitnesses in the North West District murder case at the Demerara Assizes. The deponents, who testified at the preliminary inquiry (PI) into the charge against Mark Thompson called ‘Ishley’, cannot be located to testify for the State at the jury trial.
As a consequence, Prosecutors Diana Kaulesar and Renita Singh are seeking to have their testimony admitted, on the ground that they cannot be found and are believed to be out of the jurisdiction.
For that purpose, the judge conducted a voir dire (trial within a trial) in the absence of the jury.
Defence Counsel Peter Hugh is representing the accused, who is indicted for the unlawful killing of his cousin, Romel Williams, on January 13, 2008, at White Creek Village, in North West District.
