Judge adjourns trial to January 5, 2011
THE West Bank, Demerara murder trial which had been halted when it was at its closing stages because of the sudden illness of the number three juror who was expected to recover by yesterday, has still not resumed. The juror is still unwell, and the matter is now adjourned to January 5, 2011.
Justice Winston Patterson admonished the 11 jurors yesterday that they and their sick colleague are expected to be in Court about 9 a.m. on January 5, since they would be expected to conclude the case before the beginning of the January Criminal Sessions.
At the trial, accused Lakenauth Dial, called Mohan, is facing an indictment for the murder of Farzan Khan, said to have been committed at Clay Brick Road, Canal No. 2, West Bank Demerara, on February 2, 2008.
Khan, who it is said had attended a wedding house function in the village had left the premises to purchase a soft drink when it is said he was attacked and stabbed to death.
Police investigations led to the accused being arrested and charged with murder.
At his trial, the accused, represented by Attornery-at-Law, Mr. Vic Puran, pleaded not guilty.
The Prosecution, led by Miss Latchmie Rahamat, in association with Ms. Judith Gildharie-Mursalin, assured the mixed jury that the prosecution would prove its case beyond a reasonable doubt.
However, the defence appeared to have got the better of the case up to the point when the prosecution applied and got permission from the judge to lead fresh evidence.
But the fresh evidence was never led, as the juror fell ill and could not serve.
