Court to rule on FGM’s legal challenge on Friday

Acting Chief Justice Navindra Singh is expected to make a ruling on Friday in the case filed by the Forward Guyana Movement (FGM) candidate against the Guyana Elections Commission (GECOM).

The case was called on Wednesday morning for the FGM candidate’s attorney, Vivian Williams, in response to submissions made by GECOM’s attorney, Arudranauth Gossai and the Attorney General, Anil Nandlall, SC.

Upon hearing the submissions, the Acting Chief Justice set Friday, August 29, at 2:00 pm for ruling in the case.

FGM, through candidate Krystal Hadassah Fisher, filed a case at the Demerara High Court seeking to block the September 1 General and Regional Elections, unless its candidates are included on the ballots in all 10 administrative regions.

The case centres on what the applicant says is the party’s exclusion from Regions Seven, Eight and Nine, where the party is not contesting Regional Democratic Council (RDC) seats.

The challenge has been described by the Attorney General as perhaps the “most misconceived” one of all challenges that have been made against the system.

While acknowledging that the applicant acted “with the greatest of good intentions,” he argued there was “a lack of understanding of how the system works.”

Over the past few days, as the case was heard, the AG argued that it was the applicant’s party itself that chose not to contest those constituencies.

As such, he rejected the claim that Amerindians in Regions Seven, Eight and Nine would be disenfranchised.
