THE re-trial of Terry Kissoon is nearing an end. The State on Monday closed its case following its presentation of a number of witnesses, after which, the accused led his defence in the Demerara High Court before Justice Sandil Kissoon.
The summation of the case will take place on Thursday at 09:00hrs, followed by the verdict.
The accused, Kissoon, was in December, 2013 sentenced to death by Justice Diana Insanally, after he was found guilty of the murder of Troy Smith.
The court heard then, that Kissoon fatally shot Smith on July 30th, 2010 after accusing him of stealing a motorcycle. After fleeing, he was held more than a year later in Lethem.
Kissoon, when called upon to lead his defence, had elected to give an unsworn statement that he was 300 miles away in the interior when Smith was killed. Kissoon also claimed he was wrongfully identified by Shawn Smith, a brother of the deceased, who had testified during the High Court trial that he had seen Kissoon holding a gun in his hand.
According to reports, Kissoon went to the dead man’s Lot 108 Thomas Street, Kitty residence, just before 07:00hrs on the day in question, and accused him of stealing his motorcycle. He later told Smith that he had 24 hours to return it. The allegation led to a heated argument during which Smith was shot once in the left side of his abdomen. Kissoon then fled the area.
The injured man was rushed to the Georgetown Public Hospital Corporation (GPHC) by relatives, but was pronounced dead on arrival.
The Guyana Court of Appeal on July 26, 2018 remitted the Kissoon murder case back to the High Court, for retrial during this session of the Criminal Assizes.
