SHIVANGALI Nedd and Lalta Edwards of Meadow Brook Gardens, Georgetown have filed contempt of court proceedings against businessman Lloyd Singh of Camp Street, Georgetown, asking that he be imprisoned for his contemptuous behaviour in failing to carry out an order given by Justice Franklin Holder on October 27, 2015 “to release motor lorry GSS 1860 forthwith to the applicants.” The memorandum of the motion, which has been filed in the Supreme Court Registry by attorney-at-law Savitri Parag for the plaintiffs, declared that since service of the said Order, on October 27, 2015, the defendant has refused to comply with same, and continues to unlawfully detain the said motor lorry, causing hardship to the applicants, who utilize same as a source of income.
They contend that the defendant is contemptuous of the injunction compelling him to release the vehicle, thus they are praying that the Honourable Court would grant the reliefs prayed for in the Notice of Motion.
The applicants (plaintiffs) are saying that when the defendant unlawfully detained motor lorry GSS 1860 on September 1, 2015, all its parts, including the tyres, were intact; but on November 7, 2015, when they accompanied the Supreme Court Marshal to the defendant’s premises in order to effect service of this motion, it was clear that the said motor lorry had been deprived of its wheels and battery.
The hearing is fixed for January 4, 2016.
