JUSTICE Navindra Singh will today sum up for the jury the evidence against murder accused Tyrone Rowe, called Cobra, before handing the case over to them (the jury) for their consideration and verdict.
The prosecution, conducted by Mrs Teshana Lake, said the accused had participated in an armed robbery at Plaisance on August 7, 2010, in which Troy Collymore, called ‘Collie’ and ‘Nelly’, was shot dead.
Constable Neil Thornhill, who identified the shooter as a fair skinned man and the accused as one of the armed robbers, had testified that he had picked out the accused from a lineup of eight men who were shirtless at the identification parade, held at the Brickdam Police Station.
But Constable Thornhill also testified that when he had identified the accused as one of the bandits on the night of the shooting, the accused was wearing a shirt. Thornhill conceded under cross-examination by defence counsel Mr. Huckumchand that he could possibly have picked out the wrong man at the ID parade.
Both state and defence counsels addressed the jury yesterday, with state counsel urging the jurors to find that a prima facie case had been made out against the accused, and so they must return a verdict in accordance with the evidence and the oath they had taken; and defence counsel contending that the identification was bad and the jury should accordingly return a verdict of not guilty.
The jury verdict would be delivered this afternoon.
