The Caribbean Financial Action Task Force (CFATF) has commented favourably on non- legislative interventions by the Government of Guyana on Anti-money Laundering and Combating the Financing of Terrorism (AML/CFT).
It however rejected the most recent report by government stating that it will not accept a report that does not contain a definitive date on which the amended AML/CFT Bill will be enacted by the 10th Parliament of Guyana.
Reporting at a post cabinet briefing yesterday, Presidential Adviser on Governance Ms. Gail Teixeira said that Cabinet had been advised by Attorney General and Minister of Legal Affairs Mr Anil Nandlall of the rejection of the latest Guyana report in August last to the CFATF.
Minister Nandlall had reported that the CFATF had deemed the Guyana report, he had submitted, as incomplete because of its lack of information on when the AML/CTF law will be enacted by the 10th Parliament of Guyana.
“Despite being apprised of the current situation regarding the parliamentary special select committee on the AML/CFT Amendment Bill, CFATF insisted on a definitive date of enactment by the time they meet again in November, Nandlall reported,” she said.
She said that in the meantime, though, CFATF had commented favourably on the non legislative interventions by the Government of Guyana and had urged further progress.
“So although we were given incomplete status in relation to the recommendation of the legislative instruments, CFATF noted with some satisfaction that Guyana was making progress in the non-legislative interventions which are about 20% of the recommendations under the CFATF Act,” Teixeira reported.
CFATF had reported in May last that If Guyana does not take specific steps by November 2013 to address AML/CFT deficiencies, then the CFATF will identify Guyana as recalcitrant and will take the additional steps of calling upon its members to consider implementing counter measures to protect their financial systems from the ongoing money laundering and terrorist financing risks emanating from Guyana.
The CFATF will also consider referring Guyana to the Financial Action Task Force International Cooperation Review Group (FATF ICRG).
Ms. Teixeira noted yesterday that the recent past behaviour of the Opposition in parliament in general, and specifically with regard to AML/CFT legislation, does not augur well for the future of the Bill.
