Contractor re-arrested after release from detention over Lethem arms report : –Writ of Habeas Corpus filed against police

CONTRACTOR Clive Lloyd King, detained by police in relation to a reported arms & ammunition cache at Lethem then released on a court order, was back in police custody yesterday. Consequently, his reputed wife, Sandra Shaneza Thompson, yesterday sought a writ of habeas corpus for his release.
And Chief Justice Ian Chang, SC, has issued a nisi order calling on the police commissioner to release the contractor, or show cause why he ought not to be released.        

This second motion yesterday was issued by Attorneys-at–law Peter Hugh, Miss Latchmie Rahamat and Miss Onassis Granville. In her affidavit in support of the motion, the applicant Thompson said that on the first occasion, Clive Lloyd King went voluntarily into the ‘F’ Division Headquarters at Eve Leary, on Tuesday, April 9, 2013 at about 8:30 hours, having been informed by family members upon his return from Brazil that the Guyana Police Force had issued a wanted bulletin stating that he was wanted for questioning. He was taken into custody when he went to the station.

After being detained for in excess of 24 hours, a writ of habeas corpus was filed on Friday 9th April, 2013 and was heard by the Honourable Chief Justice, Mr. Ian Chang.  It was ordered that the Rule Nisi of Habeas Corpus Ad Subjiciendum be issued and directed to the Commissioner of Police to release the body of Clive Lloyd King, unless cause is showing why the said Order of Rule Nisi of a Writ of Habeas Corpus should not be made absolute.

The motion stated that Clive Lloyd King was released on Wednesday, April 10, 2013 and was told to report to the ‘F’ Division Headquarters on April 15, 2013.

Reputedly, when Clive Lloyd King reported with his lawyers at the Division yesterday, he was told that he would have to remain for another 72 hours.

According to the applicant Thompson, Clive Lloyd King has been told that he was wanted for questioning in relation to another matter which has nothing to do with the wanted bulletin published in relation to the arms and ammunition found at Lethem.

The applicant has applied to the court for leave to issue a Writ of Habeas Corpus, directing the Police Commissioner to release King immediately, or show cause why the said Clive Lloyd King should not be released.

The applicant is asking the Chief Justice to issue an order directed to the Commissioner of Police to release or show cause. Hearing is fixed for court today.
