CJ grants Chief Co-op Development Officer Order Nisi of Certiorari against Labour PS, PSC – respondents to show why decision to send officer on leave should not be quashed

CHIEF Justice Mr. Ian Chang, S.C., has granted a Nisi Order of Certiorari directed against the Permanent Secretary in the Ministry of Labour and the Public Service Commission to show cause why the decision to send Chief Co-operative Development Officer Kareem Abdul Jabar on administrative leave should not be quashed.

The motion by Jabar, who had applied for writs of Certiorari and Prohibition — which had been heard recently before the Chief Justice — has been adjourned to April 5, when Miss Prithima Kissoon is expected to respond appropriately in representing the respondents.
On the other hand, Attorney-at-Law Mr. Roysdale Forde, representing Jabar, will adduce arguments to have the Nisi Order made Absolute.
The first order by the Chief Justice to Ms Lorene Baird, Permanent Secretary in the Ministry of Labour, Human Services and Social Security, called upon her to show cause why a Writ of Certiorari should not be issued to quash her written decision, dated February 4, 2013, to send Kareem Abdul Jabar on administrative leave on the ground and for the reason that the said decision is unlawful, ultra vires, irrational, unreasonable, wholly in excess of jurisdiction, void, of no legal effect, and is in breach of the Public Service Commission Rules of 1998.
