Prosecutor Miss Retina Singh said, “Evidence will be led to show that Mortimer Melville then pulled out a gun and told Gaitri, ‘Don’t move, or else I’ll shoot you.”
In her opening address to the jury, the prosecutor disclosed that evidence will be led to show that the two men then went outside the shop, to where Nazir Ali and two others were sitting, and Melville then placed the gun to Nazir’s neck.
They then robbed Nazir of his cell phone, chain and band; and robbed the Alis’ friend of her bracelets, and Ali’s sister, Bibi, of her ring. Thereafter, Jevon Ismond left the premises on his bicycle, with Mortimer Melville proceeding behind him. However, when Melville saw Ali attempting to reach for his gun, which was behind him in a socket, a scuffle ensued between the two men, and Nazir’s gun went off, whereupon Melville shot Nazir four times before picking up Nazir’s gun and taking it away with him.
The prosecutor said witnesses will be called to testify that, a few minutes later, Wazir Ali, brother of Nazir Ali, and Raymod Xavier, a neighbour, on seeing Nazir lying on the floor in what appeared to be blood, took him to the Georgetown Public Hospital, where he died later that night.
On August 23rd, 2007, a post-mortem was done on Nazir Ali’s body by Government Pathologist Dr. Nehaul Singh. His findings were that Ali’s death was due to multiple gunshot wounds.
On September 7, 2007, an identification parade was held by the police, and Bibi Ali, sister of Nazir Ali, who was present during the robbery/murder incident, pointed out Mortimer Melville to the police as one of the men who had robbed and killed Nazir Ali.
At another identification parade, held on February 16, 2008, Bibi Ali pointed out Jevon Ismond as the other person who had intruded the premises on the fateful night when her brother had been shot.
Accordingly, the duo was arrested and placed in custody whilst further investigations were done.
