House owner sues mechanic for not supplying protective grills …as thieves break in

MOTOR-mechanic Uthart Seelall, who allegedly failed to supply grills for a house in Essequibo in accordance with an agreement, resulted in thieves breaking and entering the building. And the owner Dyal Singh is suing the mechanic for damages and compensation in excess of $1M.
A writ to the effect was filed in the Supreme Court Registry yesterday and is expected to be heard in Bail Court on September 10th 2012.
According to the writ of summons, the defendant is by occupation a grill-work maker and fitter and resides at Cotton Field, Essequibo Coast.
In November 2010, the defendant, in writing, agreed to supply and affix two pieces of grill on the  plaintiff’s house at 1 Little  Alliance,  Essequibo Coast, to be completed by the 10th November, 2010.
The sum of $600,000 was discounted from monies owing to the  defendant by the plaintiff for  services rendered, and the said sum was in full payment to supply and fix the grill work.
But the defendant never supplied the grill on the plaintiff’s house as agreed, despite repeated demands, said the plaintiff in his statement of claim.
The plaintiff is contending that because of the negligence and or breach of agreement in not effecting  the grill, the plaintiff’s house was  broken into by thieves on two  separate occasions and articles stolen  in excess of $500,000.00 was not recovered.
The plaintiff is saying that the installation of the grill on the house was a protection from persons unlawfully entering his house.
As a consequence the plaintiff is claiming from the defendant:-

(a)   $600,000, being a sum received by the defendant from the plaintiff to affix grill on the plaintiff’s house which the defendant has refused and or neglected to do.
(b)    $1,000, 000 as damages and pecuniary compensation for the breach of agreement and loss suffered by the plaintiff as a consequence.

The plaintiff is also claiming costs.
The writ was issued by Attorney-at-Law, Mr. Robert Ramcharran on behalf of the plaintiff.
