Defence closes in Mc Coy pre-elections case

SENIOR Counsel, Bernard De Santos, representing Presidential Press Liaisonm, Kwame Mc Coy, made oral submissions to Acting Chief Magistrate, Priya Sewnarine-Beharry. The defendant is facing charges of assault and threatening language but the lawyer submitted that the injuries the virtual complainant, Stewart claimed he suffered are not substantiated by the facts related.
De Santos said Stewart alleged that McCoy gun butted him but the medical certificate tendered in court speaks of mild swelling and the virtual complainant could have caused the injury to himself.
Counsel further submitted that Mc Coy’s gun was lodged at the Police Station at the time the alleged incident occurred and it would have been impossible for him to have gun butted Stewart when he was not in possession of the weapon.
De Santos said the police can prove, through records, that Mc Coy’s firearm was, indeed, at the station.
Yesterday’s hearing brought an end to the case for the defence and the prosecution is to respond on July 24.
Particulars of the offence said McCoy, last November 12, two weeks before the general elections, lashed Stewart with a firearm in Norton Street, Georgetown.
It is alleged that happened after Stewart spoke to Mc Coy about posting photographs of presidential candidates.
McCoy is also charged with threatening Stewart, by telling him he was a marked man and should watch himself.
