Justice Franklyn Holder, the presiding judge in the Stewartville robbery/murder involving two accused, is continuing a voir-dire (a trial within a trial) to determine the admissibility of alleged oral and confession statements of accused Satnanand Sahadeo, called “Boyso”. Inspector Noel David was giving evidence for the prosecution when defence counsel Mr. George Thomas for Satnanand Sahadeo, called ‘Boyso’, objected to the witness making certain statements in relation to his client, on the ground that they were obtained in contravention of the Judges’ Rules.
Consequently, the mixed jury was sent out of sight and hearing while the leading prosecutor, Mrs. Judith Gildharie-Mursalin, began questioning her witness.
In his turn at the witness box, Inspector Joel David testified that he had told the accused, Satnanand Sahadeo, called Boyso, that he was in receipt of information that he (accused) and others had shot and killed one Vishnu Santie of Stewartville, West Coast Demerara.
According to the witness, accused Boyso had replied, ”Meh nah bin deh”.
Witness said that the accused later blurted out, “Leh me tell alyou what really happened”
It was at this stage that defence counsel Mr. George Thomas objected to the further evidence the witness was planning to give.
The accused, Peter Ray Kassim, called ‘Donkey’, a minibus driver, and Sahadeo, a cane harvester, are on trial for having murdered Vishnu Santie on Wednesday 29th June 2005 at Stewartville, West Coast Demerara.
Attorney-at-Law Mr. Hukumchand is appearing for Kassim.
The trial is continuing.
