Two Orders granted re –Sharma’s TV Station suspension controversy

Nisi Order to quash suspension and Service of Conservatory Summons on A.G.
IN respect to a Notice of Motion from Chandranarine Sharma and Savitree Singh, seeking to have their  suspension of their TV Station quashed, Acting Chief Justice Mr. Ian Chang, S.C. has granted  an Order or Rule Nisi of Certiorari  in terms of a Notice  of Motion dated 25th October, 2011.
The Nisi Order was granted on Thursday to quash the suspension decision on the ground that the members of the Advisory Committee on Broadcasting did not have the authority to advise the President in the way they did. The Nisi Order could be discharged or made absolute dependent on the evidence that follows.
Yesterday, after  hearing another application from the applicants, this time for a Conservatory  Order , with affidavit in support, and asking  that the suspension decision be  kept in abeyance until the hearing and  determination  of the  originating summons before the Court,  the Chief Justice ordered that service of the summons be effected on the Attorney  General.
That matter was adjourned to November 30.
The Nisi Order was granted by the Chief Justice on Thursday  after  hearing arguments from  Attorney-at-law Mr. Neil Boston, for the applicants.
